Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Stronger Software LLC, a Georgia limited liability company (“Sourced,” “we,” “us,” or “our”), and govern your use of the Sourced website at sourced.farm, our iOS application, and the related services we provide (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
These Terms include an arbitration agreement and a class-action waiver in Section 16 that affect how disputes are resolved. Please read them carefully.
1. Who can use the Service
You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms. By using the Service, you represent that you meet these requirements and that you are able to enter into a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
2. What Sourced is
Sourced is a community-driven directory that helps people discover local farm-direct food sellers. Listings are created and maintained by community members and by automated tools, and may also be drawn from public sources. Sourced is a directory only. We do not grow, produce, handle, inspect, certify, sell, or deliver any food, and we are not a party to any transaction or relationship between you and any seller. Any purchase, communication, or arrangement you make with a seller is solely between you and that seller.
3. Your account
You may need an account to use some features. You agree to provide accurate information, to keep it up to date, and to keep your credentials secure. You are responsible for activity under your account. Notify us at contact@sourced.farm if you suspect unauthorized use. We may suspend or terminate accounts as described in Section 15.
4. Your content
The Service lets you submit content, including listings, reviews, ratings, photos, flags, tag suggestions, and list names (“User Content”). You retain ownership of your User Content. By submitting User Content, you grant Sourced a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (for formatting and display), publish, publicly display, and distribute that User Content in connection with operating, promoting, and improving the Service, including in shared links and across our platforms.
You represent and warrant that, for any User Content you submit:
- You own it or have the rights necessary to grant the license above;
- It is accurate to the best of your knowledge and not misleading, fraudulent, or a fake or incentivized review;
- It does not infringe any third party’s intellectual property, privacy, or other rights; and
- It does not violate these Terms or any applicable law.
We are not obligated to monitor User Content, but we may review, edit, refuse, remove, or verify it at our discretion, including through automated agents that structure and cross-check listing data. Because Sourced is a community directory, accepted contributions become part of the directory’s shared, version-tracked record and may persist even if you later delete your account, in disassociated form.
5. Acceptable use
You agree not to:
- Post false, fraudulent, deceptive, or paid/incentivized reviews or listings;
- Impersonate another person or business, or misrepresent your affiliation;
- Create multiple or coordinated accounts to manipulate ratings, flags, or other community signals;
- Harass, threaten, defame, or harm others, or post unlawful, hateful, or abusive content;
- Upload content that infringes intellectual property or privacy rights, or that contains malware;
- Scrape, crawl, harvest, or bulk-download the Service or its data except as expressly permitted by us in writing or by our published API terms;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its systems, or other users’ accounts;
- Use the Service to violate any law or regulation, or for any unlawful purpose.
6. Listings are community-sourced and may be inaccurate
Listing information—including locations, hours, products, prices, availability, contact details, and tags—is contributed by the community and by automated tools and may be incomplete, out of date, or inaccurate. We do not independently verify, endorse, or guarantee any listing, seller, or product. You are responsible for confirming details directly with a seller before relying on them.
7. Food, health, safety, and legal compliance
Sourced lists farm-direct foods, which may include raw, unpasteurized, or minimally processed products such as raw milk, raw-milk cheese, eggs, honey, and produce. These products can carry inherent risks, including the risk of foodborne illness, and may be subject to federal, state, and local laws that vary by location and that may restrict or prohibit their sale, purchase, distribution, or transport.
- Sourced does not produce, test, inspect, certify, or warrant the safety, quality, legality, or fitness of any product or seller listed in the Service.
- You are solely responsible for understanding and complying with all laws that apply to you, and for evaluating the safety and suitability of any product for you and your household. Consult a qualified professional and your local authorities if you are unsure.
- You assume all risks associated with finding, contacting, purchasing from, or consuming products from sellers you discover through the Service.
Nothing in the Service is medical, health, dietary, or legal advice.
8. Sourced Premium and payments
Some features require a paid subscription (“Premium”). Pricing and features are shown at the point of purchase.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You authorize us and our payment processor to charge your payment method on each renewal.
- Web purchases are processed by Stripe. You can manage or cancel a web subscription through the customer portal linked in your settings; cancellation takes effect at the end of the current billing period.
- In-app purchasesmade through the Apple App Store are processed and billed by Apple and are governed by Apple’s terms. Manage or cancel these through your Apple account settings; we cannot cancel or refund App Store purchases on your behalf.
- Refunds. Except where required by law or expressly stated, payments are non-refundable. App Store purchase refunds are handled by Apple.
- Price changes. We may change subscription prices; we will give notice as required, and changes apply to the next billing period.
9. Intellectual property
The Service, including its software, design, text, graphics, logos, and the “Sourced” name and brand, is owned by Stronger Software LLC or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended personal, non-commercial purpose. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service except as permitted by law. If you send us feedback or suggestions, you grant us the right to use them without restriction or obligation to you.
10. Third-party services and links
The Service may link to or rely on third-party websites and services, including sellers’ own sites. We do not control and are not responsible for third-party content, products, or practices. Your use of third-party services is governed by their terms.
11. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LISTING, SELLER, OR PRODUCT INFORMATION IS ACCURATE, COMPLETE, RELIABLE, SAFE, OR LEGAL. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THESE EXCLUSIONS MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STRONGER SOFTWARE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY OR ILLNESS ARISING FROM PRODUCTS OBTAINED THROUGH SELLERS YOU FIND VIA THE SERVICE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless Stronger Software LLC and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, your dealings with any seller, or your violation of these Terms or any law or third-party right.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or others. Sections that by their nature should survive termination (including Sections 4, 9, 11, 12, 13, 16, and 19) will survive.
15. Changes to the Service or these Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect means you accept the updated Terms.
16. Governing law and dispute resolution
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules.
Informal resolution first. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at contact@sourced.farm. If we cannot resolve it within 60 days, either party may proceed as described below.
Binding arbitration. Except for the exceptions below, any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by a recognized arbitration provider under its consumer rules, before a single arbitrator, in or near Georgia (or by remote proceeding). Judgment on the award may be entered in any court with jurisdiction.
Class-action waiver.You and Sourced agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims.
Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or equitable relief in court for intellectual-property or unauthorized-access matters.
30-day opt-out. You may opt out of this arbitration agreement and class-action waiver by emailing contact@sourced.farm within 30 days of first accepting these Terms, stating your name and that you opt out. If you opt out, or to the extent arbitration does not apply, the state and federal courts located in Georgia will have exclusive jurisdiction, and you and Sourced waive any objection to venue there and waive any right to a jury trial.
17. Apple App Store
The following applies to the iOS application obtained through the Apple App Store (“App”):
- These Terms are between you and Stronger Software LLC only, not Apple. Apple is not responsible for the App or its content.
- Your license to use the App is limited to use on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the App. Direct any support questions to contact@sourced.farm.
- To the maximum extent permitted by law, Apple has no warranty obligation for the App. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation.
- Stronger Software LLC, not Apple, is responsible for addressing any claims relating to the App, including product-liability, legal or regulatory, and intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Notices and contact
Questions, notices, or support requests regarding these Terms may be sent to contact@sourced.farm.
19. General
These Terms and the Privacy Policy are the entire agreement between you and Sourced regarding the Service and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship between you and Sourced.
